1. Introduction
These Terms of Service ("Terms") govern your access to and use of Bugbybug and its related websites, applications, APIs, SDKs, dashboards, and services (collectively, the "Service").
By creating an account, accessing the Service, or using any part of it, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
Bugbybug is operated by Bugbybug, a company registered in the United States, with its principal office at 1111B S Governors Ave, Suite 27904, Dover, DE 19904, United States.
2. Definitions
- "Customer" means any individual or organization that creates, owns, or administers a Bugbybug account.
- "User" means any person who accesses or uses the Service under a Customer account.
- "Content" means any data, code, logs, screenshots, metadata, error reports, comments, files, documents, and other materials uploaded, linked, entered, or processed through the Service.
- "SDK" means the Bugbybug software development kit used to collect and transmit error telemetry and application diagnostics.
- "Project" means a distinct application or environment managed within the Service.
- "API Keys" means the keys generated to authorize access to features or ingest data into the Service.
3. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have valid parental or guardian consent and permission to enter into these Terms.
You represent and warrant that:

- The information you provide to create an account is accurate and complete.
- You will maintain the confidentiality of your account credentials.

5. Customer Responsibilities
As a Customer, you are responsible for:
- The accuracy and lawfulness of the data you send to the Service.
- Ensuring you have the right to process and transmit any personal data collected through the SDK or API.
- Providing clear notice to your users about the use of monitoring tools, error collection, and related analytics.
- Complying with your own privacy obligations and applicable laws.
- Maintaining appropriate safeguards, policies, and controls for the use of the Service.
You agree that you are solely responsible for determining whether the Service is suitable for your operational and legal needs.
6. Use of the Service
You agree not to:
- Use the Service for any unlawful purpose.
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt to access or manipulate data or systems without authorization.
- Use the Service to transmit malware, spam, malicious code, or abusive content.
- Reverse engineer, decompile, or extract source code from the Service except where explicitly permitted by law.
- Resell, sublicense, or otherwise commercialize the Service without written authorization.

Bugbybug may investigate suspected violations and may take action including suspending or terminating access, disabling integrations, or removing offending content.
7. SDK and API Use
The SDK and API are provided to support the collection, storage, and analysis of error telemetry and application diagnostics.
You agree that:
- Any data sent through the SDK or API is your responsibility.
- You must not send data you do not have permission to process.
- You are responsible for configuring retention, filtering, and redaction controls appropriately.
- You may not use the SDK to collect personal data beyond what is required for your legitimate operational needs.
- If you are processing personal data of end users, you must ensure your use of the SDK and your privacy documentation are lawful and compliant with applicable law.
8. Data Ownership and Rights
You retain ownership of any content, data, and information you upload, enter, or transmit through the Service, including application logs, crash data, and diagnostics.
Bugbybug retains ownership of the Service itself, including software, interfaces, documentation, branding, and related intellectual property.
Bugbybug may process Customer data solely to provide, maintain, secure, improve, and support the Service, and to comply with legal obligations.
9. Data Retention and Deletion
The Service may retain data according to the retention periods described in the Privacy Policy and any applicable subscription or plan terms.
You may delete data through the dashboard, API, or by contacting support, subject to any applicable retention obligations, legal requirements, or technical constraints.
Bugbybug may retain logs or records necessary for security, billing, legal compliance, or service integrity.
10. Privacy and Security
Bugbybug will process personal data in accordance with its Privacy Policy. By using the Service, you agree to that Privacy Policy.
Bugbybug will use reasonable administrative, technical, and organizational safeguards to protect data, but no system is completely secure. You acknowledge that no online service can guarantee absolute security.
11. Subscription, Fees, and Payments
Some features and plans may require a paid subscription. Fees, billing cycles, and plan terms will be communicated before purchase or renewal.
You agree to pay all fees due for the selected plan. Failure to pay may result in suspension or termination of access to paid features.
Unless otherwise stated, subscriptions renew automatically according to the selected billing cycle, unless cancelled before the renewal date.
12. Availability and Service Levels
Bugbybug aims to provide a reliable Service, but it does not guarantee uninterrupted availability, 100% uptime, or error-free operation.
The Service may be unavailable due to maintenance, system issues, third-party outages, force majeure events, or other circumstances beyond Bugbybug's reasonable control.
13. Intellectual Property
The Service and all associated content, trademarks, logos, documentation, software, and design elements are the property of Bugbybug or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, distribute, modify, or use the Service or its branding except as expressly permitted by these Terms or by written authorization from Bugbybug.
14. Feedback
If you provide ideas, suggestions, feedback, or feature requests, Bugbybug may use them without restriction or payment, and no confidentiality obligation applies to general feedback.
15. Warranties and Disclaimers
The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by applicable law, Bugbybug makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted availability.
Bugbybug does not warrant that the Service will meet your specific requirements or that it will be error-free.
16. Limitation of Liability
To the maximum extent permitted by law, Bugbybug shall not be liable for indirect, incidental, consequential, special, punitive, or loss-of-business damages, including loss of data, revenue, goodwill, or profits, even if advised of the possibility of such damages.
Bugbybug's total liability for any claim arising out of these Terms or the Service shall not exceed the fees paid by you for the Service in the 12 months preceding the event giving rise to the claim, or $100 if no fees were paid.
This limitation does not exclude liability that cannot be excluded by law, including fraud, intentional misconduct, or liability required by applicable consumer protection laws.
17. Indemnification
You agree to defend, indemnify, and hold harmless Bugbybug and its affiliates, employees, officers, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your processing of personal data or other data through the Service.
- Your infringement of third-party rights, including intellectual property, privacy, or contractual rights.
18. Termination
Bugbybug may suspend or terminate your access to the Service at any time for reasons including but not limited to breach of these Terms, non-payment, unlawful use, or abuse of the Service.
Upon termination, your right to use the Service ends immediately. You may still be responsible for any outstanding fees or obligations.
Certain provisions of these Terms will survive termination, including intellectual property rights, limitation of liability, indemnity, dispute resolution, and any rights or obligations that by their nature should survive.
19. Changes to the Service or Terms
Bugbybug may modify, suspend, or discontinue any part of the Service at any time. Bugbybug may also update these Terms from time to time.
Material changes will be communicated by email or by a notice in the product or website. Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the revised Terms.
20. Dispute Resolution; Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
Any disputes arising from these Terms or the Service will first be subject to good-faith informal resolution. If a dispute cannot be resolved informally, it shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
21. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
22. No Waiver
Failure by Bugbybug to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
23. Entire Agreement
These Terms, together with the Privacy Policy and any other written agreement specifically referenced by Bugbybug, constitute the entire agreement between you and Bugbybug regarding the Service.

25. Miscellaneous
Bugbybug may assign these Terms or any rights under them to an affiliate or successor in connection with a merger, acquisition, or sale of substantially all of its assets.
These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Bugbybug.
If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
